GOVERNMENT RESOLUTION ON THE MEASURES UNDERTAKEN IN THE AREA OF NUCLEAR POWER DEVELOPMENT

On January 13 2009, the following resolution has been adopted by the Republic of Poland government:

To ensure the national energy security, and taking into account the economic development, a Polish nuclear power program shall be developed and implemented. The draft of such program shall be developed and submitted to the Council of Ministers by the government's plenipotentiary; this program shall determine the nuclear power plants' number, size and possible sites. Moreover, the government obligates the National Treasury Minister to ensure that PGE Polish Energy Group SA shall cooperate on the program's development and implementation.

Government Information Center added the following comment:
In connection with the government resolution of January 13, 2009 on starting the work on Polish Nuclear Power Program, at least two nuclear power plants will be built. The work will be conducted simultaneously, and the operation of at least one of these nuclear power plants should be started by 2020. Nuclear power plant construction in Poland does not preclude Polish involvement in similar investments abroad. Government's Plenipotentiary for Polish Nuclear Power Program shall be charged with the coordination and supervision of the measures for the preparation of the regulatory and institutional environment, necessary for the nuclear power plant commissioning in Poland. Responsibility for the plant's construction rests with PGE Polish Energy Group SA.

REGULATORY FRAMEWORK FOR RADIATION
AND NUCLEAR SAFETY
According to the Polish law all problems of radiation protection, in the sense of protection of population and workers, radiological monitoring of the environment etc, are treated together with nuclear safety and security. Behind such a solution there is an understanding that safety (and security) of nuclear materials and facilities should be treated as a secondary issue originating from the protection against radiation, since in all cases the hazard potentially caused by any nuclear technology is related to biological effects of ionizing radiation. Thanks to such a solution in Poland there is only one joint legal approach to all aspects of radiation protection and nuclear safety, but also the state control in that area is executed by a single governmental regulatory authority, i.e. the National Atomic Energy Agency.

The activities of the President of the National Atomic Energy Agency (NAEA), as a central organ of governmental administration competent for the issues of nuclear safety and radiological protection, is regulated by the Act of Parliament of 29 November 2000 - Atomic Law (O.J. 2007, No 42, Item 276) and relevant regulations. Further tasks of the NAEA President result from many other legal acts. Since 1 January 2002 the NAEA President is supervised by the minister competent in the environmental issues. NAEA President executes his /her tasks through the National Atomic Energy Agency, which internal organization is established by the statute conferred by the Environment Minister.
